Legal framework

Egg donation: permitted in Austria, currently not in Switzerland

For many couples from Switzerland, the legal situation is the decisive reason for treatment in Austria: under Swiss law, egg donation is currently not permitted, and sperm donation is only available to married couples (as of 2026). With the amendment to the Reproductive Medicine Act, egg donation has been permitted in Austria since 2015. The Austrian legal framework is clearly defined:

  • The woman in whom the pregnancy is to be brought about must not yet have completed her 45th year of age at the start of treatment.
  • Eggs may only be retrieved for a third person from the donor's completed 18th to her completed 30th year of age.
  • Egg donation is permitted if the woman's own eggs are not capable of reproduction.
  • Treatment is possible within a marriage, a registered partnership or a cohabiting relationship.
  • Before treatment, in-depth notarial counselling on the legal consequences of the consent is provided for.
  • Anonymous donation is not permitted: from the completed 14th year of age, the child can receive information about the identity of the donor.
  • Surrogacy is prohibited in Austria – egg donation is only possible for the woman who carries the pregnancy herself.

The easiest way to start is our free fertility info evening with a personal orientation talk – via Zoom or on site. An online fertility consultation is also available. This lets you clarify your first questions without travelling; you can send us any existing findings in advance.

First consultation in Vienna

The in-depth first consultation takes place on site and usually lasts a full hour: medical history, counselling, gynaecological examination with ultrasound, initiation of the preliminary examinations and therapy planning – in German or English, as you prefer.

Treatment plan with bundled appointments

We align your treatment plan with your travel arrangements and bundle examinations and appointments wherever it is medically sensible. We coordinate follow-up appointments closely with you – at every step you know when your presence in Vienna is needed.

Preparation and check-ups

During the preparation phase we stay in ongoing contact. Where medically possible, we coordinate individual check-ups with your gynaecologist in Switzerland – we define the details together in your treatment plan.

Treatment in Vienna

The central treatment steps – such as egg retrieval or embryo transfer – take place at our institute in Vienna. The embryo transfer takes only a few minutes and requires no anaesthesia; we tell you in advance how many days you should plan for.

Follow-up care – also from a distance

After the transfer, we accompany you through the hormonal support and the pregnancy test and remain available for you. An established pregnancy is then looked after by your gynaecologist at home – like any other pregnancy.

Our main institute is located at Lainzer Straße 6, 1130 Vienna, in the green district of Hietzing near Schönbrunn Palace. There are direct flights to Vienna from Zurich, Geneva and Basel; from the airport you can reach us by public transport with the City Airport Train (CAT) and underground line U4 to Hietzing station. Vienna is also well connected by rail from Switzerland – for example from Zurich, by night train if you wish.

Fertility treatment in Austria: what couples from Switzerland ask us.

Do you also treat couples from Switzerland?

Yes, of course we also treat couples from Switzerland – from the initial work-up to IVF and ICSI through to egg donation. Treatment is available in German or English, and we plan the appointments so that they fit in well with your travel.

Why do Swiss couples choose egg donation in Austria?

Because under Swiss law it is currently not permitted – in Austria, by contrast, it has been permitted since 2015, with clear legal requirements: the recipient must not yet have completed her 45th year of age at the start of treatment, eggs may only be retrieved from the donor's completed 18th to her completed 30th year of age, and treatment is possible within a marriage, registered partnership or cohabiting relationship (as of 2026). What applies to sperm donation?

Under Swiss law, sperm donation is currently only available to married couples (as of 2026). In Austria it is also open to unmarried couples in a cohabiting relationship and to female couples. Do we have to travel to Vienna for every appointment?

No. The first contact is possible without travelling: our free orientation talk takes place online or on site, and we also offer an online fertility consultation. The in-depth first consultation with examination and ultrasound then takes place on site in Vienna; we coordinate the further appointments closely with you and bundle them wherever it is medically sensible.

How many stays in Vienna are necessary?

That depends on the treatment and cannot be stated in general terms. As a principle, we plan your treatment so that you manage with just a few well-prepared stays: the first consultation, the central treatment steps such as egg retrieval or embryo transfer – and close coordination from a distance in between, where possible together with your gynaecologist in Switzerland. In the first consultation you receive a concrete plan with all the required visits.

Can we use medical findings from Switzerland?

Yes, please bring any existing findings – such as hormone levels, semen analyses or reports from previous treatments – to the first consultation, or send them to us in advance. This makes the consultation more concrete. Your records do not have to be complete, however: we determine together which examinations are still needed.

Do the rules on preimplantation genetic testing differ?

Yes, the requirements are regulated differently in the two countries. In Austria, preimplantation genetic testing has been clearly regulated since 2015 – for example after recurrent miscarriages or several unsuccessful IVF attempts. Whether it is an option in your situation is something we clarify in a personal consultation; the analyses are performed in our own in-house genetics laboratory.
